Firestone Statement Regarding Opinion of Seventh Circuit Court of Appeals We are grateful to receive the Seventh Circuit Court of Appeals' thoughtful and well-reasoned opinion. This decision confirms what we have been saying all along: The issues and circumstances involved in these no-injury lawsuits are far too varied to justify class certification. It would make the legal process less efficient and less manageable, exactly the opposite of what a class action is intended to achieve. We are pleased that the Court's decision reversing class certification demonstrates and articulates why these cases are not suitable for class certification in either federal or state courts.
